Hrvatski Telekom faces record fine ever: €3.76 millions
According to Poslovni, quoting a report in 24 Sata, the verdict was delivered by the High Misdemeanour Court in Zagreb and This Hrvatski telekom fine is the highest ever fine imposed on a telecom operator in Croatia.
It adds that as the largest telco in the country controlling critical infrastructure, Hrvatski Telekom is required to submit price lists to HAKOM to prevent it from selling its services at a lower cost (dumping) and thereby gaining new customers in a non-market way.
Its rule-breaking practice began in the summer of 2016 and lasted until the following spring.
Fine is 1% of Hrvatski Telekom ‘s revenue in 2016
The Zagreb court’s first verdict was delivered this April and HT’s appeal, including on the grounds that it had already paid a fine of HRK50,000 for the same offence, was dismissed by the High Minor Offences Court.
Hrvatski Telekom has nevertheless avoided the prospect of being fined double the HRK28 million – €3.76 millions, or 1% of its revenue in 2016.
‘At Hrvatski Telekom, we have just received a judgment and are analyzing further legal steps. In any case, we consider that the amount of the sentence, in view of the offense charged to us, is not appropriate. Specifically, the charged offense relates to a failure to submit a price list to HAKOM for one of the tariffs in 2015. Otherwise, Hrvatski Telekom is constantly changing its tariffs and, accordingly, duly submits notices to HAKOM, as required by law, HT answered.
